UAE Voluntary Disclosure: Fixing Tax Errors Before an FTA Audit

Magnifying glass over a document to review a UAE voluntary disclosure

UAE Voluntary Disclosure: The Short Answer

You file a return, then a month later you spot a wrong figure. Maybe input VAT was claimed twice, or a supply went into the wrong box. The question is what to do before the Federal Tax Authority (FTA) finds it first.

The answer is a UAE voluntary disclosure. It is the formal route to correct a filed return, refund application or tax assessment. Done early, it costs far less than an error the FTA discovers during an audit. Here are the five rules to hold on to:

  • Disclose before the audit notice. After the FTA notifies an audit, a fixed penalty is added.
  • Check the size of the error. Underpaid tax above AED 10,000 normally needs a formal filing.
  • Watch the clock. Published guidance gives 20 business days from the day you become aware.
  • Expect a monthly charge. The penalty is 1% of the tax difference for each month from the original due date.
  • Pay the difference. A UAE voluntary disclosure corrects the record, but the tax itself is still due.

This guide is written for foreign founders and investors who run, or plan to run, a UAE company. It explains the law as published, shows a worked example, and says clearly where you should confirm details with the FTA.

What Is a UAE Voluntary Disclosure?

A UAE voluntary disclosure is a self-reported correction. You tell the FTA that a return, a refund application or a tax assessment contained an error or omission, and you supply the right figures. The FTA reviews the application, adjusts its records, and tells you what extra tax and penalty is due.

The legal base sits in Article 10 of Federal Decree-Law No. 28 of 2022 on Tax Procedures, with detail in the Executive Regulation, Cabinet Decision No. 74 of 2023. The penalty amounts sit in a separate Cabinet decision, covered below. You can read the primary texts and guides on the Federal Tax Authority (FTA) website.

Why does the route exist? Because tax returns are prepared by people, and people make mistakes. The law gives you a way to fix an honest error in return for a lower, predictable penalty. In short, a UAE voluntary disclosure rewards the taxpayer who speaks first.

It is not the same as an appeal. If you think the FTA is wrong about an assessment, that is a dispute process with its own deadlines. A UAE voluntary disclosure is for the opposite case: you think you were wrong, and you want to correct it.

When a UAE Voluntary Disclosure Is Required

Not every mistake needs a formal filing. The rules depend on the size and direction of the error. The summary below follows Crowe’s note on when a voluntary disclosure must be filed and later 2026 guidance. Wording was amended during 2026, so treat the table as a map, not as the law itself.

SituationUsual route
Underpaid tax above AED 10,000UAE voluntary disclosure, within 20 business days of becoming aware
Underpaid tax of AED 10,000 or lessCorrect in the next return not yet due, or the return for the period you found it
No later return exists (for example after deregistration)UAE voluntary disclosure within 20 business days
Refund claimed that you were not entitled toUAE voluntary disclosure
Tax overpaidVoluntary disclosure to recover it; a right, not an obligation
Error that does not change the tax dueUsually corrected in a later return, unless the FTA directs a disclosure

Two points deserve attention. First, the AED 10,000 line is about the tax difference, not the size of your turnover. Second, the FTA may decide that even a no-difference error needs a formal filing. When in doubt about a UAE voluntary disclosure, file rather than guess.

Typical triggers for foreign-owned companies include input VAT claimed on blocked items, sales reported in the wrong emirate, a missed reverse-charge entry on imported services, or a corporate tax return that used the wrong revenue figure. If your company is new, our guide to VAT registration in the UAE explains the return cycle that these errors usually sit in.

UAE Voluntary Disclosure Deadline and Time Limit

There are two clocks. The first is short. Published guidance says that where a disclosure is required, you must submit it within 20 business days of becoming aware of the error. If several errors relate to the same period, the clock starts when you find the first one.

The second clock is long. Published 2026 guidance says the Tax Procedures Law stops a UAE voluntary disclosure once five years have passed from the end of the relevant tax period. A narrow transitional exception is described for some refund applications. Because that point is easy to misread, check the law with your adviser.

What counts as “becoming aware”? The law does not hand you extra time to investigate indefinitely. In practice, write down the date your team confirmed the error, who confirmed it and what they relied on. That note protects you if the FTA later asks why the filing came when it did.

The penalty also grows with time. As the next section shows, each month between the original due date and your filing adds 1% of the tax difference. So the UAE voluntary disclosure deadline is not only a legal limit. It is also a cost control.

The FTA Voluntary Disclosure Form: VAT 211

For VAT, the FTA voluntary disclosure form is VAT 211. You file it in your EmaraTax account, not on paper. It lets you correct a return, a refund application or an assessment, and it is the form most guides mean when they say “Form 211”.

The form asks for the period, the tax difference by box, and an explanation of what went wrong. You also upload supporting documents. Think of tax invoices, import entries, reconciliations and the corrected calculation. A clear explanation speeds review.

Standard review time is described as 20 business days, which can run longer for complex corrections. Do not wait for the FTA’s reply before paying. Where the difference is payable, the penalty rules treat a payment due date of 20 business days for disclosures, so settle on time.

Other taxes use their own screens. Corporate tax and excise errors are also corrected through EmaraTax, but the form names and fields differ from VAT 211. Use the service that matches the tax and period concerned, and keep a copy of the submission receipt.

UAE Voluntary Disclosure Penalties From April 2026

The penalty rules changed. Cabinet Decision No. 129 of 2025 replaced the older tables and, according to published summaries, took effect on 14 April 2026. The best English comparison we found is Crowe’s summary of Cabinet Decision No. 129 of 2025, which sets old and new rules side by side.

SituationOld rule (Decisions 49 and 108 of 2021)New rule (Decision 129 of 2025)
UAE voluntary disclosure filed before audit notice5% to 40% of the tax difference, rising by year1% of the tax difference for each month from the original due date until submission
No disclosure before the FTA notifies an audit50% fixed plus 4% monthly15% fixed plus 1% monthly on the tax difference
Incorrect returnAED 1,000 first time, AED 2,000 if repeatedAED 500, unless corrected before the due date or by disclosure with no tax difference
Unpaid tax after the due date2% plus 4% monthly14% a year, charged monthly, on the unpaid tax

The direction is clear. The new framework is lighter and simpler. A UAE voluntary disclosure now costs a flat 1% for each month of delay, and the 50% fixed charge for being caught is cut to 15%.

Still, the gap between disclosing early and being caught remains. The fixed 15% applies only if you did not disclose before the FTA notified you of an audit. That single fact is the reason to move quickly.

One point needs care. Our sources do not settle which rules apply to a disclosure filed now about a period before 14 April 2026. Commentators differ, and we did not find an official transitional rule. Ask the FTA or your adviser before you quote a figure to your board. For the wider schedule, see our guide to UAE corporate tax penalties.

A Worked Example: What Waiting Costs

The numbers below are illustrative. They assume the new framework applies, whole months, and a UAE voluntary disclosure about VAT. They leave out the late-payment charge, which would be added separately.

A Dubai trading company underpaid VAT by AED 80,000 because it claimed input tax on an ineligible expense. The error was found six months after the original return due date.

  • Disclosure filed before an audit notice: 1% × 6 months × AED 80,000 = AED 4,800 penalty.
  • Same error, found by the FTA first: a fixed 15% of AED 80,000 = AED 12,000, plus the same AED 4,800 monthly charge = AED 16,800.
  • Gap: AED 12,000, about 15% of the tax difference, for the sake of speaking first.

Add the AED 80,000 of tax itself in both cases. A UAE voluntary disclosure reduces the penalty, not the tax. And each extra month before you file adds AED 800 in this example.

How to File a UAE Voluntary Disclosure

Treat the filing as a small project with an owner and a date. A practical sequence is below.

  1. Confirm the error. Rebuild the figure from invoices and ledgers, and record the date you became aware.
  2. Size the tax difference. Compare it with the AED 10,000 line to decide between a later return and a formal disclosure.
  3. Check the period. Make sure it is within the five-year window.
  4. Prepare evidence. Gather invoices, customs entries, the corrected calculation and an explanation.
  5. File in EmaraTax. Use VAT 211 for VAT, or the matching service for another tax.
  6. Pay on time. Settle the tax difference and the penalty once the FTA confirms the amount.
  7. Fix the cause. Add a review step so the same error does not return next quarter.

The authorised signatory or tax agent normally files. If your accounts are kept by an outside bookkeeper, confirm who holds EmaraTax access before the 20-day clock runs down. A UAE voluntary disclosure stalls quickly when nobody can log in.

What Changes Once the FTA Notifies an Audit

An audit notification is the line that matters. Before it, a UAE voluntary disclosure attracts the 1% monthly charge. After it, the published summaries describe a fixed 15% on top. The monthly charge keeps running until you disclose or the FTA issues its assessment.

The FTA can also request records, ask for explanations and issue its own assessment. Your leverage shrinks, because the authority now sets the agenda. That is why advisers urge founders to run a quick health check on past returns before any notice arrives.

Foreign investors have extra reasons to act. A company with a clean record is easier to sell, to refinance and to deregister. If you plan an exit, our guide to UAE VAT deregistration shows why open tax questions can delay closing the file.

Free zone companies are not exempt. Even a company that expects a 0% rate on qualifying income files returns and keeps records, and an error in those filings is still an error. For the accounts side, see free zone audited accounts. A clean set of statements makes any later UAE voluntary disclosure simpler to support.

If you are unsure how exposed your company is, a review before the notice is cheaper than a response after it. You can ask us about a compliance check through our Business Setup service, which covers licensing, tax registration and ongoing filing support for foreign-owned companies.

Common Mistakes

  • Waiting for certainty. Every month adds 1%. File when the error is confirmed, not when the file is perfect.
  • Assuming small means ignorable. Smaller errors still need correcting in the next return.
  • Forgetting the cash. A UAE voluntary disclosure does not cancel the tax. Budget for it.
  • Using the wrong tax route. VAT 211 is for VAT only.
  • Skipping the root cause. The same error repeated in later periods looks careless.
  • No paper trail. Without a dated note of when you found the error, you cannot show you acted within 20 business days.

FAQ

What is a UAE voluntary disclosure?

A UAE voluntary disclosure is a formal correction you submit to the Federal Tax Authority when you find an error in a filed tax return, refund application or tax assessment. For VAT the form is VAT 211, filed through EmaraTax. It replaces the wrong figures on record and sets what extra tax and penalty you owe.

What is the deadline for a UAE voluntary disclosure?

Published guidance on Article 10 of the Tax Procedures Law’s Executive Regulation says to file within 20 business days of becoming aware of an error that underpaid tax by more than AED 10,000. Smaller errors can often go into your next return. Because the rules were amended in 2026, confirm the current wording on the FTA site.

What is the penalty for a UAE voluntary disclosure?

Under Cabinet Decision No. 129 of 2025, in force from 14 April 2026, a UAE voluntary disclosure filed before the FTA notifies an audit carries a penalty of 1% per month on the tax difference. The month count runs from the original due date until you submit. The older tiers of 5% to 40% were replaced.

What happens if I disclose after the FTA announces an audit?

If you have not disclosed before the audit notification, the same published summaries describe a fixed 15% penalty on the tax difference on top of the 1% monthly charge. The monthly part runs until you disclose or the FTA issues an assessment. Disclosing before the notice avoids the fixed 15%.

Can I correct a small VAT error in my next return instead?

Often yes. Published guidance says an underpayment of AED 10,000 or less can be corrected in the next VAT return that has not yet fallen due, without filing VAT 211. A UAE voluntary disclosure is still needed if there is no such return, for example after deregistration, or if the FTA directs you to file one.

Is there a limit on how far back a UAE voluntary disclosure can go?

Published guidance says the Tax Procedures Law blocks a voluntary disclosure once five years have passed from the end of the tax period concerned. Errors from the oldest periods can therefore age out of the correction window. Check the exact period against the current law before you rely on this.

Does the same process apply to corporate tax errors?

The Tax Procedures Law and the penalty decision cover the taxes the FTA administers, so a corporate tax return error follows the same logic: disclose early, pay the difference and expect the 1% monthly charge. The filing screens and form names differ by tax, so use the corporate tax services in EmaraTax.
