Most overseas buyers ask one question first: do I pay tax on the rent? The honest answer for Dubai rental income tax is that it depends on who owns the property and how it is rented.
A private individual who lets a flat to a tenant is treated very differently from a company that owns the same flat. This guide sets out how Dubai rental income tax works, using the Federal Tax Authority (FTA) guides, so you can see which side you are on.

Dubai Rental Income Tax: The Short Answer
Dubai rental income tax is not a personal income tax, because the UAE has none on rent. What exists is corporate tax, and the way it reaches rent depends on the owner.
- Individual, no licence: rent is Real Estate Investment income. It is excluded from corporate tax, whatever the amount.
- Individual with a licence: a holiday home permit or a licensed property business makes the rent business income. Tax applies once turnover passes AED 1 million in a calendar year.
- Company: rent is part of taxable income. The first AED 375,000 is taxed at 0%, and the rest at 9%.
- Foreign company: earning rent from UAE property creates a nexus, so it is taxed and must register.
The test is the structure, not the tenant. Two owners with identical flats can end up with different Dubai rental income tax results.
Which Rules Decide Dubai Rental Income Tax
Three FTA texts matter for Dubai rental income tax. I read the first two in full and the third in the relevant sections.
- The Real Estate Investment for Natural Persons guide (CTGREI1, October 2024) explains the exclusion for individuals.
- Cabinet Decision No. 49 of 2023 sets the AED 1 million turnover test and lists wages, personal investments and Real Estate Investment as outside it.
- The Non-Resident Persons guide (CTGNRP1) and the General Corporate Tax Guide (CTGGCT1) cover nexus, rates and relief. They are listed on the FTA corporate tax page.
The underlying law is Federal Decree-Law No. 47 of 2022. These guides explain it, and the FTA says they are general guidance, so the law and your own facts come first.

When an Individual Pays No Tax on Rent
This is the case most owners are in, and here Dubai rental income tax is nil. The FTA defines Real Estate Investment as selling, leasing, sub-leasing or renting land or real estate property, where the activity is not conducted, and does not need to be conducted, through a licence.
If that fits, the guide says the income, and the related expenditure, is excluded from corporate tax. The amount does not matter. Several points follow from the guide:
- Size is irrelevant. Owning many properties does not by itself change the result.
- Tenant type is irrelevant. A flat or a shop let to a company is still an investment.
- Agents are fine. Renting through a licensed property manager does not alter the nature of your income.
- Fixed or variable rent is fine, as long as you take no part in running the tenant’s business.
- Ejari is not a licence. The guide calls it an administrative record.
There is a cost to this treatment. Expenses linked to excluded income are not deductible, and a loss gets no relief. Related-party leases must also be at arm’s length.
A rental that qualifies never counts toward the AED 1 million threshold. That keeps the excluded rent from pulling other income into tax.
When an Individual’s Rent Becomes Taxable
The exclusion stops where a licence starts, and Dubai rental income tax begins. The guide gives four common situations.
| Situation | Treatment per the FTA guide |
|---|---|
| Holiday home let under a Dubai tourism permit | Licensed activity, so not Real Estate Investment. Income is business income. |
| Rent collected through your own licensed sole establishment | Operating through a licence, so the exclusion does not apply. |
| Licensed business plus separate unlicensed flats | Unlicensed flats can still be excluded, if you can show they are separate. |
| Co-owned villas | Each owner is assessed on their own share and facts. |
In the guide’s example of a Dubai owner with sixteen apartments, fourteen are holiday homes with permits and two are normal lets. The fourteen are within corporate tax. The two are excluded. Shared costs are split on a fair, consistent basis.
Dubai rental income tax then applies only if the business turnover passes AED 1 million in a calendar year. Small Business Relief can help below AED 3 million of revenue, but the text I read limits it to tax periods ending on or before 31 December 2026. Check whether that has changed. If you run short lets, read our guide to Dubai holiday home rental alongside this one.
Two more traps. A lease to a hotel operator for a lump sum stays excluded, but running the hotel yourself under a licence does not. And if you let property through a wholly owned company, the guide says the result depends on who is the principal in the tenancy.
Dubai Rental Income Tax for Companies
For a company, Dubai rental income tax follows the standard corporate rules. A company is a juridical person and a taxable person. The individual exclusion does not apply to it. Its rent goes into taxable income, after allowable expenses.
- The first AED 375,000 of taxable income is taxed at 0%.
- Taxable income above that is taxed at 9%.
- Qualifying Free Zone Persons are different. Under the guide, income from residential and other non-commercial property in a free zone is taxed at 9% as regular income, without losing qualifying status. There is no 0% band on it.
Holding through a company gives you a real trade-off on Dubai rental income tax. A company can deduct costs and may offer a cleaner way to hold several assets. It also brings registration, records and an annual return that an individual avoids.
Our article on buying property in Dubai through a company covers whether that trade is worth it, and the guide to a UAE holding company covers group structures. Then run your numbers through our Dubai net rental yield method, using the after-tax figure.
Non-Resident Owners and the Nexus Rule
Living abroad does not by itself bring Dubai rental income tax. The test is who the owner is.
- Non-resident individual: the guide says the nexus concept does not apply to natural persons. Unlicensed rent is Real Estate Investment income, so it is excluded.
- Non-resident company: deriving income from UAE immovable property creates a nexus. It is taxed on that income at the same 0% and 9% bands, and it must register.
On Dubai rental income tax, the Non-Resident guide also says that owning land or buildings does not, on its own, create a permanent establishment. Its example is a foreign engineering company that leases UAE land to an events firm. The land is not a permanent establishment, but the company has a nexus and is taxed on the rent.
If your ownership runs through an overseas company, this is the section to read twice. A foreign entity holding Dubai property is a very different case from you holding it personally.
Home-Country Tax Is a Separate Question
Everything above on Dubai rental income tax is the UAE side only. I make no statement about any other country’s tax law.
Whether your home country taxes the same rent, or gives credit for what you pay here, depends on its own rules and on any tax treaty. The FTA guide notes that double tax agreements override the UAE law where they conflict, when residence is decided for individuals.
Proof of UAE residence is a document question, and our guide to the UAE tax residency certificate explains how that works. Ask a qualified adviser in your home country to confirm the foreign side in writing.
5 Essential Checks Before You Rely on “Free”
Use these checks to test your own Dubai rental income tax position.
- Who owns it? Name the legal owner. Individual, UAE company and foreign company give three different answers.
- Is there a licence? Check for a holiday home permit or a licensed property business anywhere in your chain.
- Is it clearly separate? If you run a licensed business, keep records that show the flats are a distinct activity.
- Are any parties related? Leases and management contracts with related parties need arm’s-length terms.
- What does home say? Get the foreign tax view in writing before you price the deal.
Limits of this article. It reflects the FTA guides as I opened them in October 2026. I read the real estate guide in its official PDF. I read copies of the General and Non-Resident guides dated 2023, so check the FTA site for newer versions. This is general information, not tax or legal advice.
FAQ
Is rental income taxed in Dubai?
For an individual who rents out property without a business licence, no. The FTA treats it as Real Estate Investment income and excludes it from corporate tax, whatever the amount. A company is different. Its rent is part of its taxable income, at 0% on the first AED 375,000 and 9% above that. There is no separate personal income tax.
Do I pay UAE tax if I rent out my Dubai apartment as a non-resident?
A non-resident individual who rents out property without a licence is treated like a resident one. The income is not a business activity, so it is excluded from corporate tax. The FTA guide says the nexus rule does not apply to natural persons. A foreign company that earns rent from UAE property does have a nexus and is taxed.
Does a holiday home permit change the answer?
Yes. The FTA guide treats a Dubai Department of Economy and Tourism holiday home permit as a licence. Income from a licensed holiday home is then business income, not excluded Real Estate Investment income. It counts toward the AED 1 million turnover test for individuals, and a company pays tax on it either way.
Is an Ejari tenancy registration a licence?
No. The FTA guide says an Ejari registration or termination is an administrative record, not a permission to conduct a business. Registering a normal residential tenancy in Ejari does not take the rent out of the exclusion. A holiday home permit from the tourism authority is a different thing and does count as a licence.
Can a company that owns Dubai property pay no tax?
Not by default. A UAE company is a taxable person, and rent is part of its taxable income. The first AED 375,000 is taxed at 0%, and the rest at 9%. Small Business Relief can remove tax for revenue up to AED 3 million, but only for periods ending by 31 December 2026 in the guide I read.
Does the UAE tax treatment decide what my home country charges?
No. UAE rules decide only the UAE side. Whether your home country taxes the same rent, or gives credit for tax paid here, depends on its own law and any tax treaty. This article does not cover that. Confirm it with an adviser who knows your home country before you rely on a UAE position.

Start with the ownership line: who holds the title, and is any licence involved? That single answer settles most Dubai rental income tax questions. If your structure is mixed, or you hold through a foreign company, ask for a second opinion before you sign.
