Delayed Handover Dubai: The Short Answer
A delayed handover Dubai buyer faces is not automatically a breach that ends the contract. First your SPA decides what counts as late. Then the law decides what you can do about it. Most buyers have a contractual window, a complaint route and, in serious cases, a court or arbitration claim.
If your developer has missed the date, you are probably asking four things. Is it really late yet? What can I claim? How do I prove it? Who do I complain to? This delayed handover Dubai guide answers each one for an off-plan buyer, often someone abroad who cannot visit the site. It promises no refund, because none is guaranteed.
A delayed handover Dubai dispute is mostly a paper exercise. The buyer who keeps clean records and acts in the right order is in a much stronger position than the one who sends angry messages. For the normal end of the journey, see our guide to the Dubai property handover process.
Start With the SPA: Completion Date and Extension Clause
Every delayed handover Dubai case begins with the Sale and Purchase Agreement. Find three things: the anticipated completion date, the extension clause and the cancellation clause.
The anticipated completion date
The SPA gives an anticipated completion date, not a guaranteed one. Afridi & Angell notes that developers usually complete by that date, but often hold a contractual right to extend it by a further 12 months. Check whether the date is a calendar date or tied to an event, such as the issue of a completion certificate.
The SPA extension clause
The SPA extension clause is the main reason a delayed handover Dubai buyer cannot claim on day one. BSA Law reports that SPAs commonly allow an extension of 6 to 12 months, and that the buyer may be able to cancel if the unit is still not ready after it ends. Look at three points: whether the extension is automatic, whether the developer must give notice, and what counts as a valid reason.
Force majeure and compensation
Many contracts also excuse delay caused by events outside the developer’s control. Read that wording closely. A vague force majeure clause can turn a late project into a lawful one. Also look for a delay-compensation clause. BSA says some SPAs pay interest for delay beyond the completion date. Others say nothing. Our guide to developer due diligence shows how to test these clauses before you sign.
What the Law Says About Developer Late Completion
Dubai has no single “late handover law”. The protection comes from several instruments, and the summaries below come from official text and law-firm commentary. A delayed handover Dubai claim is built from them together, alongside the rules on developer late completion.
Escrow protection
Law No. 8 of 2007 on escrow accounts requires project funds to sit in an escrow account. Article 15 says that if a project is not completed, the escrow agent must, after consulting the Department, take measures to preserve depositors’ rights and ensure the project is completed or depositors are refunded. This is the legal basis for a RERA off-plan refund when a project fails, as opposed to merely running late.
Registration and the Oqood
Law No. 13 of 2008 governs the Interim Real Property Register. Article 10 says a developer may not sell off-plan in a project that the competent entities have not approved, and any such contract is void. Your Oqood proves your registered interest in the unit. See Oqood vs title deed for what that document does and does not prove.
Termination and project cancellation
Afridi & Angell explains that, under Article 20 of Executive Council Resolution 6 of 2010, a buyer may ask a court to terminate the contract in cases covered by general principles of law. Their summary lists a failure to deliver the unit without justifiable reason among the grounds. They also cite Article 23, under which RERA may cancel a project where the developer has no intention of implementing it or is grossly negligent, and the developer must then refund payments under Law 8 of 2007.
Their note on the Decree is a summary made when the decree was announced, so confirm the current text with a lawyer. A Afridi & Angell inBrief on off-plan construction delays also cites Article 246 of the Civil Code, which requires a contract to be performed in good faith.
The common mix-up on percentages
Some guides quote completion bands of 60% and 80% when they discuss delayed handover Dubai refunds. Those bands appear in Article 11 of Law 13 of 2008 as replaced by Law No. 19 of 2020. They set what a developer may do when the buyer defaults. They are not the buyer’s remedy for a late developer. Do not assume they give you a refund percentage.

What an Off-Plan Buyer Can Claim
What you can claim in a delayed handover Dubai case depends on the contract and on how serious the delay is. The realistic options, from lightest to heaviest, are these.
- A revised date in writing. Ask the developer to confirm the new completion date and the reason. An addendum can help, but it can also waive rights, so read it first.
- Contractual delay compensation. If the SPA has a delay clause, claim exactly what it says, with the calculation.
- Cancellation under the SPA. Some contracts allow it once the extension has expired. Terms on refunds differ.
- Court or arbitration. A buyer may seek termination and recovery of payments. The result depends on the evidence.
- Project cancellation. If RERA cancels the project, escrow funds are refunded under Law 8 of 2007.
BSA Law says that, where an SPA has no specific delay clause, a refund of the full amount paid plus 9% interest may be possible. That is one law firm’s view. Developer and portal blogs quote other figures, including 12% interest, and I could not verify them against official text, so treat those numbers as unverified. If a delayed handover Dubai purchase was financed, ask your bank how the loan behaves while the unit is late. Our guide to the off-plan payment plan shows how instalments are structured.
How to Document the Delay
Evidence decides most delayed handover Dubai disputes. Start the file now, even if you hope to settle.
- Collect the contract set. Keep the SPA, every addendum, the reservation form, the payment plan and the Oqood certificate.
- Record the timeline. Note the original date, each date the developer has given since and the reason it gave.
- Save all messages. Keep emails, WhatsApp chats and sales-agent promises. Export them with dates.
- Prove your payments. Keep receipts and bank transfers that show you paid on schedule.
- Check site progress. Afridi & Angell says RERA monitors construction progress and that a copy of its audit report can often be obtained from the DLD website. Compare it with the developer’s claims.
- Take dated photos. Ask someone on site, or use a representative under a power of attorney.
- Send a written notice. Ask the developer for the new date and the basis for any extension, and keep proof it was sent.
This file is the base for every delayed handover Dubai route below. It also helps when the unit is finally ready, because an unresolved dispute can affect how you take over the keys. See snagging in Dubai for the inspection that follows delivery.
The RERA and DLD Complaint Route
RERA regulates developers and projects in Dubai, and a RERA off-plan complaint is the usual first official step in a delayed handover Dubai case. Afridi & Angell advises trying to settle with the developer first, then lodging a complaint with RERA, and only then considering arbitration or court.
Before you file
Write to the developer and give a reasonable deadline. Attach the SPA clause you rely on. Keep the answer. A delayed handover Dubai complaint that shows you tried to resolve things is easier for a case officer to act on.
What to attach
Attach the SPA, the Oqood certificate, proof of payments, the timeline and the messages. State what you want: a confirmed date, compensation or cancellation. Be precise about the unit and the project.
What it can and cannot do
A delayed handover Dubai complaint can lead to mediation and puts the delay on the regulator’s record. It does not guarantee a refund. Only a binding agreement, a decision of the competent forum or a project cancellation does that. The exact form and channel are set by the DLD, so check them on its website before you start.
Arbitration, Court and When to Call a Lawyer
If a delayed handover Dubai complaint fails, the SPA dispute clause decides the forum. Afridi & Angell says it is most commonly arbitration, with DIAC and DIFC-LCIA the popular venues, and that without an arbitration clause the case goes to the Dubai courts. Arbitration is usually faster and private. Court is paper-based, and documents must be translated into Arabic.
The same firm’s 2019 note gave a Dubai court fee cap of AED 40,000. Treat that as a dated figure and ask your lawyer for the current one. Also ask about enforcement: winning a claim against a developer in difficulty is not the same as being paid.
Call a lawyer before you take any irreversible step. Those steps are sending a termination notice, signing an addendum that moves the date, stopping payments or starting proceedings. For a delayed handover Dubai investor abroad, our Real Estate Advisory service can help you prepare the file and the questions before you instruct counsel. It is not a law firm and does not give legal advice.
Mistakes That Weaken a Delayed Handover Dubai Claim
Most weak delayed handover Dubai claims fail because of what the buyer did, not what the developer did. Avoid these.
- Stopping payments without advice. A missed instalment can start the developer’s own buyer-default procedure, with a 30-day notice from the DLD under Article 11 as replaced by Law 19 of 2020.
- Signing an addendum blind. A new date may waive your right to claim for the earlier delay.
- Relying on verbal promises. A sales agent’s reassurance on a call is not evidence.
- Waiting too long. Delay can mean losing the evidence and the chance to use some contract rights.
- Trusting social media figures. Refund percentages quoted in blogs and forums are not the law.
- Ignoring the resale option. Some buyers prefer to assign a delayed unit rather than litigate, subject to developer consent and fees.
A 7-Step Plan for Delayed Handover Dubai Buyers
Use this order for any delayed handover Dubai case. It keeps your options open and your costs down.
- Read the completion, extension, force majeure and cancellation clauses in your SPA.
- Work out whether the extension window has expired.
- Build the evidence file described above.
- Write to the developer and ask for a dated answer.
- Keep paying on schedule unless a lawyer advises otherwise.
- File a RERA complaint if the answer is vague or silent.
- Take legal advice on arbitration, court or negotiated exit before the extension window or your limitation period runs out.
Following these steps does not make a refund certain. It makes your position clear, and that is what a developer, a regulator or an arbitrator looks at first.
Limits of This Guide
I read the official text of Laws 8 of 2007, 13 of 2008 and 19 of 2020 on the Dubai legislation portal. For Resolution 6 of 2010 I could rely only on law-firm summaries, including Afridi & Angell summary of Decree 6 of 2010, not on the current official wording. Court-fee and timing figures come from a 2019 note. Figures from developer and portal blogs are marked as unverified. This delayed handover Dubai guide is general information, not legal advice, and no outcome is promised.
FAQ
How long can a developer delay handover in Dubai?
Most SPAs set an anticipated completion date and let the developer extend it, commonly by 12 months according to Afridi & Angell and BSA Law. BSA says 6 to 12 months is typical. What applies to you is written in your own completion clause, so read it and any force majeure wording first.
Can I cancel my off-plan purchase if handover is delayed?
Possibly. Afridi & Angell notes that a buyer may ask a court to terminate if the developer fails to deliver without justifiable reason, and many SPAs allow cancellation once the extension ends. Success depends on the contract and the facts, so take legal advice before you send any termination notice.
Am I entitled to compensation or a refund for the delay?
Only as far as your SPA and the law allow. Some contracts fix delay interest. BSA Law says that where the SPA is silent a refund plus 9% interest may apply, but that is one firm’s reading, not a promise. Treat any refund as a claim you must prove.
How do I complain to RERA about a delayed off-plan project?
Write to the developer first and keep the reply. Then file a complaint with RERA through the Dubai Land Department channels, attaching your SPA, Oqood certificate, payment receipts and correspondence. Procedures change, so check the current form on the DLD website. RERA can act against a project in cases of gross negligence.
Should I stop paying instalments while the unit is late?
Usually not without advice. Missed instalments let the developer start the buyer-default process under Article 11 of Law 13 of 2008 as replaced by Law 19 of 2020, which starts with a 30-day notice. Ask a lawyer whether to keep paying under a written reservation of rights.
Does the escrow account protect me if the project stalls?
It protects the money, not the timetable. Law 8 of 2007 requires project funds to be held in escrow. Article 15 says that if a project is not completed, the escrow agent must, after consulting the Department, act to preserve depositors’ rights and ensure completion or refund of their payments.
When should I hire a lawyer for a delayed handover?
Hire one before you send a termination notice, sign an addendum that moves the date, withhold a payment, or start proceedings. A Dubai lawyer reads the SPA, checks whether the dispute goes to arbitration or court, and tells you what a claim is likely to cost. Do it early, not after the developer stops replying.
