Power of Attorney for Dubai Property: The Short Answer
An owner who lives abroad usually reaches the same moment: a buyer is ready, a tenant needs a signature or the developer wants a handover, and the owner cannot fly in. A power of attorney for Dubai property lets another person sign for you. It solves the travel problem. It also hands that person real power over your asset.
The rules got stricter in 2025. According to law-firm summaries of Dubai Land Department (DLD) Circular No. 29/R/2025, issued on 16 July 2025, the document must name the exact transaction, be verified on official judicial portals, and, if signed abroad, be legalised and no more than two years old. Broad wording such as “full authority to manage property” is not enough for a sale.
My view: use a power of attorney for Dubai property only for a defined job, with a named attorney you can hold accountable, and cancel it when the job is done. This guide explains the types, the signing route from abroad, what happens at closing, the risks and seven safeguards. It is general information, not legal advice.
What a Power of Attorney for Dubai Property Does and Does Not Do
A power of attorney is a signed authority in which you, the principal, allow another person, the attorney or agent, to act for you. A power of attorney for Dubai property is mostly used for three things: buying, selling and handling day-to-day matters such as paperwork, utilities or tenancy renewals.
A power of attorney for Dubai property does not transfer ownership. The title deed stays in your name. It also does not change who is legally responsible: you remain bound by what the attorney does within the powers you gave. If the attorney signs a sale at a price you did not intend but the text allowed it, the problem is the text, not the attorney’s memory.
It is also not always needed. Property management is normally run under a management agreement, and many routine tasks do not require you to sign in front of the DLD. Our guide to property management for overseas owners explains what to delegate and what to keep. Use a power of attorney for acts that need your signature before a registration authority, and keep it narrow.
This article covers individual owners. If a company owns the property, different corporate documents apply. See our guide to buying property in Dubai through a company for that route.
The Wording the DLD Expects in a Power of Attorney for Dubai Property
The most useful detail in the 2025 circular is the wording rule. As summarised by BSA Law, the power of attorney for Dubai property must expressly authorise the specific transaction, and “generic or broad language (such as ‘full authority to manage property’) is not sufficient” and may lead to rejection. The table shows the examples BSA Law lists.
| Transaction | Wording the circular accepts (examples) | What I would check |
|---|---|---|
| Sale | “Sale of real estate”, “transfer for consideration”, “sale to oneself or to others” | Name the unit. Decide whether the attorney may sell to themselves; I would say no unless you intend it. |
| Purchase | “Purchase for oneself”, “joint purchase” or “co-purchase”, with the ownership share | State the share and the budget ceiling. |
| Gift | “Grant of real estate”, “donation”, “transfer without consideration” | Rarely needed. Treat it as the highest-risk power. |
| Mortgage | “Real estate mortgage” or “security mortgage”; for a surety, whether it covers a third party’s debt or your own | Do not grant it unless you are borrowing. It can put your asset behind someone else’s debt. |
The same summary says the circular also covers usufruct and musataha rights. It adds a rule that a power of attorney cannot be used to change the title holder’s data unless that power is written into the text.
Analysis, not a quote from the circular: the “sale to oneself” wording deserves attention. An attorney who can sell to themselves has a conflict of interest, because they sit on both sides of the price. If your attorney is a friend, a relative or an agent who earns a commission, I would remove that phrase and write the buyer’s name or a minimum price into the document.
The circular does not require this. It is a safeguard I would add. Our selling property in Dubai guide covers the sale steps that follow.
Where to Sign a Power of Attorney for Dubai Property
You have three practical routes for signing a power of attorney for Dubai property, and the right one depends on where you are.
1. Sign in the UAE. You appear before a notary in the UAE, which is simplest when you are already in Dubai for a visit. The document can then be verified on the issuing authority’s portal. BSA Law lists Dubai Courts, Abu Dhabi Courts and the Ministry of Justice portal, enotary.moj.gov.ae, as the official verification sites.
2. Sign abroad and legalise it. This is the route the circular describes in most detail. A power of attorney issued outside the UAE is accepted only if all four conditions are met, as summarised by BSA Law on Mondaq (published 19 August 2025):
- It was issued within the two years before it is submitted.
- It is notarised in the issuing country, legalised by the UAE embassy or consulate and attested by the UAE Ministry of Foreign Affairs.
- The physical original is presented. Uncertified electronic or scanned copies are not accepted.
- If it is not in Arabic, it has a full legal translation by a UAE-licensed translator.
Some countries require their own foreign ministry to certify the notary before the UAE embassy will legalise it. The summaries I read do not cover that step, so ask the embassy for the current chain before you sign. Courier the original early, because a delay on the paper side can stall a closing.
3. Use an e-notary. Dubai Courts launched a smart e-notary service in July 2021 that lets customers complete notary transactions online, with powers of attorney among the listed services, according to Gulf News. Property Finder’s April 2026 explainer says non-residents with a valid passport can use it through UAE Pass and a live video call, and that real estate transactions may have extra requirements.
Here the honest answer is that I could not find an official statement that a remotely notarised document is accepted for every DLD disposition. The route is attractive, so confirm acceptance with your conveyancer or the registration centre before you rely on it for a sale.

How the Power of Attorney for Dubai Property Is Checked at Closing
The 2025 circular changed how a power of attorney for Dubai property is tested. Per BSA Law, the Registrar, and by extension brokers and conveyancers, must verify the validity, currency and scope of each power of attorney through the issuing authority’s official website. The use of QR codes to verify a power of attorney is “strictly prohibited under all circumstances”. A QR code cannot serve as the verification, so do not rely on one.
The Registrar also cross-checks the principal’s name, Emirates ID and passport number against the DLD system. If the document quotes an expired passport or ID, a copy of that document must be provided. A foreign power of attorney stays acceptable if the principal’s details are still accurate at submission.
Payment gets its own rule. When a sale is closed through an attorney, BSA Law lists three options: a manager’s cheque in the seller’s name for the full amount, a cheque in the attorney’s name with a receipt that the money was received on the seller’s behalf, or a notarised acknowledgement from the owner confirming receipt. This is where owners get hurt, so the next section deals with it directly.
The Real Risks of a Power of Attorney for Dubai Property
Most failures of a power of attorney for Dubai property are not fraud. They are loose drafting and misplaced trust. Four risks matter most.
Over-broad authority. A document that lets the attorney “sell, mortgage and manage” gives them three separate powers. Even where wording is accepted, you carry the consequences of each one.
Control of the money. If the attorney is allowed to receive proceeds, the funds pass through their hands. The cheque in the attorney’s name option exists in the circular, which tells you the market treats it as normal. For a seller abroad, I would insist on a manager’s cheque in my own name or a bank transfer to my own account.
Conflict of interest. An agent who is also your attorney earns a commission on a sale and controls the timing. That is not wrong, but it removes a check. Separating the roles costs a little more and protects you.
Stale or mismatched paperwork. A foreign document older than two years, an expired passport number or a missing Arabic translation can stop a transfer after the buyer has paid a deposit. The delay then becomes your dispute with the buyer.
Fact versus analysis: the circular rules above are reported by a law firm; the ranking of risks is my analysis. I have not seen published data on how often these problems occur, so I do not claim any.
7 Essential Safeguards Before You Sign
This is the framework I would use for any power of attorney for Dubai property. It is my own checklist, not an official one.
| # | Safeguard | Why it matters |
|---|---|---|
| 1 | One job per document | A sale authority should not also allow a mortgage or gift. |
| 2 | Name the property | Unit number, building and title details stop use on another asset you own. |
| 3 | Set price and buyer limits | A minimum price or a named buyer limits the damage of a bad decision. |
| 4 | Write an end date | The two-year rule applies to foreign documents; for others, the text sets the term. |
| 5 | Control the proceeds | Pay into your account or by manager’s cheque in your name. |
| 6 | Separate attorney and agent | Avoid one person holding both authority and a commission. |
| 7 | Keep a verified copy and a revocation plan | You must be able to cancel it quickly and prove you did. |
Before you send the original power of attorney for Dubai property, ask the person who will use it, the registration centre or the developer to read the draft. A five-minute review of the wording is cheaper than a rejected transfer. For the purchase side, check the figures in our guide to the cost of buying property in Dubai so the attorney works to a budget you set.
Ending a Power of Attorney for Dubai Property
Do not leave a finished power of attorney for Dubai property open. According to Property Finder’s July 2026 guide, a revocation should be in writing and notarised by a UAE Notary Public, with additional attestation if the original was issued abroad. It is then submitted to the issuing authority, or to the DLD for property documents, and the attorney and any relying bank or developer should be notified in a way that creates proof.
The same guide says the death of the principal ends the power of attorney automatically, and lists legal incapacity too. It also says verbal cancellation is not recognised. Note that this guide cites no statute, so treat it as practical guidance and confirm the route with the notary.
The death point on a power of attorney for Dubai property links to something many overseas owners skip. If you die while a power of attorney for Dubai property is open, it does not decide who inherits the unit. That is the job of a will. Read our guide on the Dubai will for expats alongside this one.
My View: Who Should Hold Your Power of Attorney
Opinion, not advice. For a one-off sale or purchase with a power of attorney for Dubai property, I would choose a UAE-licensed lawyer or conveyancer with a narrow, named-property document, and pay for it. The cost is small next to the value of a Dubai unit, and a professional has a licence and insurance to lose.
A relative in the UAE is fine for routine matters where little money moves. I would not give a relative a sale power with proceeds control unless the price is fixed and the funds go straight to my own account.
The argument I hear most is “my agent already knows the property, so give them everything”. That convenience is real, and so is the conflict. An engineer would say do not put the person who earns from the outcome in charge of the control. Keep the roles apart, keep the scope small and keep the end date short.
Limits of This Article
Limits of this article. It reflects pages I opened in October 2026: BSA Law’s summary of DLD Circular No. 29/R/2025 on its own site and on Mondaq, a Gulf News report on the Dubai Courts e-notary service (July 2021), and Property Finder guides dated April and July 2026.
I did not read the text of the circular itself. The Dubai Courts page I tried returned an error, and I found no official statement on remote e-notary acceptance, current notary fees or the revocation procedure. The circular is more than a year old and I found no amendment, but practice at registration centres can change. This is general information, not legal advice, and no outcome is guaranteed.
FAQ
Can I buy Dubai property with a power of attorney?
Yes, an attorney can sign for you if the document expressly authorises the purchase. The DLD circular summarised by BSA Law lists wording such as purchase for oneself or joint purchase with the ownership share stated, and says generic language is not enough. The signing, the payment and the title still follow normal rules, so check the draft with the developer or a lawyer before you sign it.
Can someone sell my Dubai property with a power of attorney?
Yes, if the document says so in clear terms. BSA Law reports that the circular expects wording such as sale of real estate or transfer for consideration. A document that only gives authority to manage the property is not a sale authority and may be rejected at the registration stage.
Is an online or e-notary power of attorney accepted for a property sale?
I could not confirm this from an official source. Dubai Courts launched its e-notary service in 2021 and lists powers of attorney among the documents it covers, and the DLD circular names official judicial portals for verification. Neither source says that a remotely notarised document is accepted for every DLD disposition. Ask the registration centre or your conveyancer before you rely on it.
How long is a power of attorney valid in Dubai?
There is no single answer. For a power of attorney issued abroad, the circular requires that it was issued within the two years before submission to the DLD. For one signed in the UAE, the validity depends on what the document itself says, so I recommend writing an end date into the text.
How do I cancel a power of attorney for my Dubai property?
Property Finder’s July 2026 guide describes a written revocation, notarised in the UAE (with extra attestation if the original came from abroad), submitted to the issuing authority or the DLD for property documents, with notice to the attorney and any bank or developer relying on it. The guide cites no statute, so confirm the route with the notary that issued the document.
Does a power of attorney end when the owner dies?
Property Finder’s guide says the death of the principal ends the power of attorney automatically, and also lists legal incapacity. After a death, the property is dealt with under the owner’s will or the applicable succession rules, not by the old attorney. That is why a power of attorney is no substitute for an estate plan.
Your Next Step
Before you instruct anyone, write down the one job the document must do, the property it covers, the price or budget limit and the date it should end. Then have a UAE-licensed professional check the wording against the current DLD requirements.
