You hear about a launch before it is public. A broker asks for a deposit to hold your place. That request is an expression of interest Dubai off-plan buyers meet often, and it is easy to say yes too fast.
This guide explains what an expression of interest Dubai off-plan deposit is, what the law says about the money, and when a refund is realistic. It also lists the risks I would check first.

What an Expression of Interest Dubai Off-Plan Means
An expression of interest, or EOI, is an early signal of intent. You say you want a unit in a project that is about to launch. The developer, or an agent for it, records your name and your preferred unit type.
Many launches ask for a deposit with it. The deposit puts you in the queue for the first choice of units. Prices, floor plans and payment terms may not be final at that point.
Here is the key point. An expression of interest Dubai off-plan request is a market practice. I could not find an official Dubai text that defines it or sets rules for it. The documents that carry legal weight come later, and I describe them below.

It helps to see where the EOI sits in the buying sequence. Each step has a different legal weight.
| Step | What it is | Legal weight |
|---|---|---|
| 1. Expression of interest | Request to join the queue, often with a deposit | Set only by the form you sign |
| 2. Reservation / booking | Unit, price and payment plan are fixed | Usually binding, with forfeiture terms |
| 3. Sale and purchase agreement (SPA) | The full sale contract | Governs the buyer-developer relationship |
| 4. Oqood registration | SPA recorded in the Interim Property Register | Registered evidence of your rights |
Is an Expression of Interest Binding?
There is no single answer, because there is no standard form. The wording decides. Some forms are only a request for information with a refundable deposit. Others read like a reservation in disguise.
Look for these signals in any expression of interest Dubai off-plan form:
- A named unit and price. This suggests a booking, not a simple queue place.
- A forfeiture clause. It says you lose the deposit if you withdraw.
- A deadline to convert. It forces you to sign the next document by a set date.
- Silence on refunds. That is the worst case. You then depend on goodwill.
Once you sign the SPA, the position is clearer. A Khaleej Times legal answer notes that the SPA covers the price, completion date, compensation for breach and force majeure. It says the relationship is governed by those terms. See the Khaleej Times explanation for the legal references.
Where the EOI Money Should Sit
Dubai protects off-plan buyer money through escrow accounts, and that is the test for any expression of interest Dubai off-plan payment. Law No. 8 of 2007 requires a developer who wants to sell units off-plan to apply to the Dubai Land Department to open an escrow account. The request must include a trade licence, the title deed, approved plans and an audited cost statement.
The same law says off-plan purchasers’ payments are deposited in an account in the name of the project. It adds that the account is dedicated to building that project, and that creditors of the developer cannot attach it. You can read the full text in the official Dubai legislation portal.
This matters for an expression of interest Dubai off-plan deposit. If the project has no registered escrow account yet, the money may have no legal home. That is not proof of fraud. It is a reason to slow down.
RERA gives a clear warning. After the Dubai Land Department fined three developers AED 500,000 each for marketing projects without completing off-plan registration, a RERA director said investors must check that projects are licensed and registered with an escrow account through the Dubai REST app. He added that they should not pay anything outside the project’s escrow account. The Gulf News report has the statement.

EOI and Oqood: Two Different Steps
Oqood is the digital system for registering off-plan sale agreements. Under Law No. 13 of 2008, off-plan dispositions are entered in the Interim Property Register. A sale that is not entered in that register is void, according to the article quoted by Khaleej Times.
The sequence matters. The developer first registers the project and obtains its approvals. Then your details and the sale agreement are recorded, and an Oqood certificate is issued as evidence of your rights.
An expression of interest Dubai off-plan deposit is not part of that chain. It gives you no registered interest and no Oqood certificate. Do not treat an expression of interest Dubai off-plan receipt as proof that you own, or have secured, a unit.
If a dispute arises after you sign and register, the Dubai Land Department can try to conciliate between buyer and developer under Executive Council Resolution No. 6 of 2010. That route assumes a registered contract. It is another reason to move from EOI to a registered SPA only when the project checks out.
Can You Get an EOI Deposit Back?
This is the question behind most searches for an expression of interest Dubai off-plan refund. My honest finding is that I found no Dubai rule that sets a standard refund for EOI deposits. So the answer sits in your paperwork.
Three situations usually decide the outcome of an expression of interest Dubai off-plan refund:
- You withdraw before launch. Many forms allow a refund here. Check for an admin fee and a time limit.
- Launch terms differ from what you were shown. A refund is stronger when the form ties your interest to a stated price or payment plan.
- You were allocated a unit. The deposit often turns into a booking payment. Withdrawal after that may mean forfeiture.
To protect a refund, do three things. Get the refund terms in the same document as the receipt. Pay only to the account named for the project or the developer, never a personal account. Keep every message, because a promise made by chat is hard to prove without it.
The wording also affects what you can do later. If you plan to sell a unit before completion, read our guide to off-plan resale in Dubai, because early commitments can affect transfer rules and fees.
7 Costly Risks of an Expression of Interest Dubai Off-Plan Deposit
These are the risks I would test before paying any expression of interest Dubai off-plan deposit.
- Project not yet registered. Without registration and an escrow account, your money has weaker protection.
- Payee is not the escrow account. A broker or personal account is a red flag.
- Unclear refund wording. If the form is silent, you have no agreed right to your money.
- Sales pressure. “Only a few units left” is a sales tactic. A real launch will still allow time to read a form.
- Final price not fixed. You may commit before you see the payment plan. Compare it with our guide to Dubai off-plan payment plans.
- EOI mistaken for a registered right. Only the registered SPA gives you an Oqood certificate.
- Weak developer record. An early deposit with an untested developer is the most expensive mistake.
If you are still deciding between a launch and a finished unit, our comparison of off-plan versus ready property sets out the trade-offs.
How Abu Dhabi Treats an EOI
The contrast with Abu Dhabi is useful for anyone weighing an expression of interest Dubai off-plan offer. In February 2026 the Abu Dhabi Real Estate Centre introduced a digital system on its Madhmoun platform. According to Gulf News, developers launching new off-plan projects there must register EOIs online, and the funds go into a government-managed escrow account supervised by ADREC.
I found no equivalent official EOI system for Dubai. Do not assume that Abu Dhabi protection applies to a Dubai launch. For an expression of interest Dubai off-plan, the protection comes from project registration and the escrow account, not from the EOI itself.
Checklist Before You Pay a Dubai EOI
Run this list before you pay any expression of interest Dubai off-plan deposit.
- Check registration. Confirm the project and its escrow account in the Dubai REST app.
- Read the form twice. Mark the refund, forfeiture and conversion clauses.
- Name the payee. It should be the escrow account or the developer, as stated on the form.
- Get a receipt. It should show the amount, date, project and unit type.
- Test the developer. Review past deliveries and any complaints.
- Ask about the next step. Ask when the SPA is signed and when Oqood registration follows.
- Take a day. A legitimate launch still allows a short review by a lawyer.
Limits of this article. It reflects the official Law No. 8 of 2007 text and press reports I opened in October 2026. Law No. 13 of 2008 is quoted through Khaleej Times, not the official text. Rules and DLD practice can change, so check current DLD and RERA guidance. This is general information, not legal advice.
FAQ
What is an expression of interest Dubai off-plan request?
It is a pre-booking request. You tell a developer or its agent that you want a unit in a coming launch, and you usually pay a deposit to be in the queue. It is not the sale contract. The binding documents come later: the reservation form and the sale and purchase agreement.
Is an EOI deposit refundable in Dubai?
It depends on the wording you sign. I found no Dubai law that sets a standard EOI refund rule. Some forms say the money is fully refundable until launch. Others say it becomes non-refundable once you are allocated a unit. Get the refund terms in writing before you pay anything.
Is an EOI legally binding in Dubai?
Not by default. The form itself decides. A document that only records interest and promises a refund is weak as a commitment. One that fixes a unit, a price and a forfeiture clause can bind you. Read it as a contract, and ask a Dubai lawyer if the wording is unclear.
Where should I pay an off-plan EOI deposit?
RERA at the Dubai Land Department urges buyers to check the project is registered with an escrow account in the Dubai REST app, and not to pay outside that escrow account. If the project is not yet registered, treat any request for money as a risk and ask why.
Is an EOI the same as Oqood registration?
No. Oqood registers the signed off-plan sale agreement in the Interim Property Register, after the developer has registered the project. An EOI sits before that step. It gives you no registered interest in a unit, and no Oqood certificate.
Can I withdraw my EOI if I do not like the final price?
Often yes, but only if the form says so. Check whether the deposit is returned if the launch price or payment plan differs from what you were shown. If the form is silent, assume you have to negotiate, and keep every message and receipt.
Your Next Step
Before you pay, ask for the form, the payee details and the escrow confirmation in writing. If any of the three is missing, pause. A real expression of interest Dubai off-plan offer will survive a day of checking.
